Basement water damage claims in Chicago

In a Chicago basement, the way the water got in decides which part of your policy pays and how much. We trace each wet area to its source, match it to the right coverage, and present the claim with the evidence the carrier asks for.

311Water in Basement report To send a sewer crew, the City needs these answers.
  1. The address
  2. Whether the water is clean or dirty
  3. Where it is coming from: floor drain, toilet, shower
  4. How many inches have backed up
  5. Basement, crawl space or ground level

Five ways water reaches a Chicago basement, and the coverage each one points to

Policies sort water by how it arrived, not by how much damage it did. Read across the row that matches your basement. The exact words on your own forms still decide, so we read them before the claim goes in.

How the water came inWhat it usually looks likePart of the policy it points toWhat to keep for the claim
Up through a floor drain, toilet or laundry tubGrey or dark water with a sewer smell, rising during or right after heavy rainThe water backup endorsement, up to the limit printed on your declarations pageYour 311 request number, a photo of the drain, the water line on the walls and the date of the storm
Over the top of the sump pitClear or muddy water spreading out from the pit, often when the power went outUsually the same endorsement, if its wording names sump overflow; the power outage wording matters hereThe pump itself, its age, and when the power went off and came back
From a pipe, water heater or washer hose that gave wayClean water from one spot, often with a broken fitting or split line you can seeThe main homeowners policy at its own limits, when the failure was suddenThe failed part and the plumber's invoice that names it
Through cracks in the walls or the joint at the floorDamp patches and puddles that grow over days, worst after snowmelt or a long wet spellOften treated as groundwater or long-term seepage; we check whether a covered event started itDated photos showing when the water first appeared and how it spread
Over the ground, through window wells or a doorwayWater pouring in from the yard, the alley or the streetA flood policy, not the homeowners policy; the City asks you not to use the Water in Basement report for water that came through windowsPhotos of the water outside, and your flood policy number if you have one

Drain backup and flood get mixed up more than any other pair, and the difference between them is the difference between two separate policies. Our guide to sewer backup versus flood goes through it in detail, and the sewer backup claims page covers what the endorsement pays for once it applies.

When the backup limit is smaller than the basement

Many Chicago basements are finished: carpet, drywall, a bedroom or an office, the furnace and the laundry. A backup endorsement with a low limit can run out before the cleanup is done, and the carrier will often stop there.

Before we accept that, we look at each wet area on its own. A water heater that split in the same storm, a supply line that let go, or a stack that cracked inside the wall is ordinary water damage under the main policy, and it is not counted against the backup limit. We document each source separately so the estimate shows which damage belongs to which coverage.

How the backup limit gets used up, and how it is chosen in the first place, is set out in our article on the water backup endorsement limit. When the cause is a pipe, our burst pipe damage claims page explains why the timing of the leak matters.

What to record from the first hour to the first week

A Chicago basement claim is won or lost on what was written down while the water was still there. This is the order we ask our clients to follow.

  1. First hour

Stay out of deep water and photograph the line

If the water reaches outlets or appliances, do not walk in; have an electrician or the utility shut the power off. From the stairs, photograph the water, the drain or pit it came from, and a tape measure standing in it, so the depth in inches is on record.

  2. Same day

Report it to 311 and to your insurer

File a Water in Basement report by calling 311, at 311.chicago.gov or in the CHI311 app, and keep the request number. Call your insurer to open the claim and write down the claim number and the name of whoever you spoke to.

  3. Days 1 to 3

Stop the damage, keep the receipts

Water extraction and drying can start before the adjuster visits. Keep every invoice and the moisture readings the drying company takes, because they show how far the water travelled into walls and floors.

  4. Before the curb

List what goes out to the alley

Photograph every damaged item with its label or model number before it is thrown out, and keep a cut piece of the carpet and pad. Our checklist of what to photograph after property damage covers the rest.

  5. First week

Watch the walls you cannot see into

Wet drywall and insulation that stay closed up can grow mold within days. If the carrier's estimate only dries what is visible, our page on mold damage claims explains how a mold loss ties back to the water that caused it.

Bungalow, two-flat or condo: whose policy pays for the basement

Chicago's housing changes who files the claim. The same inch of water can mean one policy in a bungalow and three in a two-flat.

Single-family bungalow

One owner, one homeowners policy. The finished space, the furnace and everything stored downstairs are claimed together.

On a backup, that means the walls and the belongings share one endorsement limit, which is why the cause of each wet area matters so much.

Two-flat or three-flat with a garden unit

The owner's policy covers the building: walls, floors, the boiler and the shared laundry. The tenant's own renters policy covers the tenant's furniture and clothes.

If the garden unit cannot be lived in, the lost rent can be part of the owner's claim. Our page on rental property claims shows how that rent is counted.

Condo building

The association's master policy usually covers the common basement, the mechanical room and the structure. Your own unit policy covers what you keep in your storage space and any improvements that are yours.

Where one policy ends and the other starts is written in the declarations of the association. Our article on condo and HOA insurance claims walks through reading them.

Chicago basement claim questions

Does homeowners insurance cover a flooded basement in Chicago?

It depends on how the water got in. A pipe or appliance that suddenly failed is covered under the main policy. Water that backed up through a drain or sump is covered only by a water backup endorsement, up to its limit. Water that came over the ground needs a flood policy.

Should I call 311 before I call my insurance company?

Do both on the same day. The 311 Water in Basement report sends a City sewer crew and gives you a request number for the claim file. The call to your insurer opens the claim.

The garden unit of my two-flat flooded. Whose policy pays?

Your policy as the owner pays for the building. Your tenant’s renters policy pays for the tenant’s belongings. Lost rent can be claimed under your policy if it includes fair rental value or loss of rents coverage.

Do you handle basement water claims in Chicago?

Yes. We represent homeowners and property owners across Illinois, Chicago included, and we inspect the basement in person.

What does a basement water claim cost me?

Nothing to start. We are paid an agreed percentage of the insurance money paid on your claim, written into the contract you sign, and if nothing is paid you owe us nothing.
